Article 1 (Purpose)
These Terms of Service govern the rights, obligations, responsibilities, and other necessary matters between Bukcs Pte. Ltd. (hereinafter referred to as the "Company") and the user regarding the use of the decentralized exchange (DEX) based cryptocurrency wallet service (hereinafter referred to as the "Service") provided by the Company.
Article 2 (Definitions)
The definitions of terms used in these Terms of Service are as follows:
- "Service" means all blockchain-related services provided by KOOKMIN Wallet, including DEX wallets, token swaps, asset management, and staking.
- "User" means a person who agrees to these Terms of Service and uses the Service.
- "Wallet" means a software-based cryptocurrency wallet used to store, manage, and transfer the User's cryptocurrency assets.
- "Private Key" means a cryptographic key used to access the User's cryptocurrency assets and sign transactions.
- "DEX (Decentralized Exchange)" means a decentralized exchange operated through smart contracts without a centralized authority.
Article 3 (Effect and Modification of Terms)
(1) These Terms of Service shall become effective upon being posted on the service screen or notified to users by other methods.
(2) The Company may modify these Terms of Service within the scope of not violating Singapore laws and regulations and MAS (Monetary Authority of Singapore) regulatory guidelines.
(3) If the Terms of Service are modified, the changes will be announced 7 days prior to the effective date.
(4) If a User does not agree to the modified Terms of Service, the User may stop using the service and delete the application (disconnect the wallet).
Article 4 (Provision of Services)
(1) The Company provides the following services to the User:
- Creation and management of DEX-based cryptocurrency wallets
- Token swaps and decentralized transaction brokerage
- Multi-chain asset inquiry and transfer
- Smart contract integration and DApp browser
- Linking .dex domains to wallet addresses through the DEXignation service
(2) The Company may temporarily suspend or restrict the provision of the service in the following cases:
- During system inspection, maintenance, or upgrade operations
- In the event of blockchain network failure or congestion
- In the event of force majeure situations such as natural disasters, hacking, or cyber attacks
- When the provision of the service is prohibited by Singapore laws or MAS regulations
Article 5 (Obligations of the User)
(1) Users must comply with these Terms of Service and relevant laws and regulations.
(2) Users must not use the Service for illegal purposes such as money laundering (AML), countering the financing of terrorism (CFT), tax evasion, fraud, or other violations of Singapore and international regulations.
(3) Users are prohibited from unauthorized access to or theft of other people's wallet information or assets.
(4) Users must not disrupt the normal operation of the Service (e.g., hacking, DDoS attacks, etc.).
Article 6 (Limitation of Liability and Indemnification)
(1) The Company shall not be held liable for the irreversibility of transactions or fluctuations in network fees arising from the nature of blockchain networks.
(2) The Company shall not be held liable for any loss of assets caused by the loss or leakage of private keys due to the User's negligence or intent.
(3) The Company shall not be held liable for asset losses caused by vulnerabilities, bugs, or hacking of the KOOKMIN Wallet smart contracts.
(4) The Company shall not be held liable for any decline in the value of cryptocurrency caused by market volatility.
Article 7 (Intellectual Property Rights)
Intellectual property rights for software, algorithms, designs, content, etc., used in the service belong to the Company. However, KOOKMIN Wallet-based components to which open-source licenses apply shall follow the respective licenses.
Article 8 (Governing Law and Jurisdiction)
These Terms of Service shall be interpreted in accordance with the laws of Singapore, and any dispute related to the use of the service shall be submitted to the Singapore Central Court as the court of first instance.
